1. Acceptance of Terms

Welcome to PayFever. These Terms of Service ("Terms") govern your access to and use of the PayFever website located at payfever.com (the "Website") and our waitlist signup service. By accessing or using the Website and joining our waitlist, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not access or use the Website or join our waitlist.

2. Description of Service

PayFever is an AI platform that pays users for their data while providing protection from disruptive AI technologies. Currently, we are in the pre-launch phase and operating a waitlist for early access to the platform. By joining our waitlist, you will receive updates about our platform launch and may be granted early access when available.

3. Eligibility

You must be at least 18 years of age to join the PayFever waitlist and use our services. By joining our waitlist, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

4. Waitlist Registration

Account Information

When you join our waitlist, you agree to provide accurate, current, and complete information about yourself, maintain and promptly update your information to keep it accurate and complete, maintain the security of your password and accept all risks of unauthorized access to your account, and notify us immediately if you discover or suspect any security breaches related to your account.

One Account Per Person

You may only create one waitlist account per email address. Creating multiple accounts or providing false information may result in removal from the waitlist.

5. Marketing Communications Consent

By joining the PayFever waitlist and providing your contact information (email address and/or phone number), you expressly consent to receive marketing and promotional communications from PayFever, including email messages regarding PayFever updates, promotions, and announcements, SMS text messages sent using automated telephone dialing systems or prerecorded messages, and voice calls including prerecorded voice messages and live calls from PayFever representatives.

Key Terms of Consent

  • Consent is voluntary: Your consent to receive marketing communications is not a condition of joining the waitlist or using PayFever services
  • Message frequency: Approximately 2-4 messages per month; frequency may vary
  • Message charges: Message and data rates may apply; standard carrier charges apply
  • Opt-out rights: You may opt out at any time by texting "STOP" to our messages or emailing [email protected] or [email protected]

6. Prohibited Conduct

You agree not to provide false, inaccurate, or misleading information when joining the waitlist, use the Website or services for any unlawful purpose or in violation of these Terms, attempt to gain unauthorized access to our systems, servers, or networks, interfere with or disrupt the integrity or performance of the Website, use automated means (bots, scripts, etc.) to access the Website or create waitlist accounts, collect or harvest any information from the Website or other users, impersonate any person or entity or misrepresent your affiliation with any person or entity, or transmit any viruses, malware, or other harmful code.

7. Intellectual Property Rights

The Website and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, and the design, selection, and arrangement thereof) are owned by PayFever, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

8. Disclaimer of Warranties

THE WEBSITE AND WAITLIST SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PAYFEVER, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

10. TCPA and Marketing Compliance

PayFever complies with the Telephone Consumer Protection Act (TCPA), Federal Communications Commission (FCC) regulations, and Mobile Marketing Association (MMA) guidelines. By providing your phone number and consenting to receive marketing communications, you acknowledge that you are the subscriber or customary user of the phone number provided, you have authority to provide consent for that number, you understand that consent is not required to make any purchase, and you may revoke consent at any time by following the opt-out instructions provided.

11. Governing Law

These Terms and your use of the Website shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If we make material changes, we will notify you by email or through a prominent notice on the Website prior to the changes taking effect.
